Conduct and Ethics Branch

The Conduct and Ethics Branch is responsible for developing and maintaining the Department’s guidelines on managing complaints, misconduct and unsatisfactory performance for the public service and teaching service. The branch provides procedural advice and support to managers and principals in relation to the guidelines and manages appeals against disciplinary action.  It also provides advice in relation to equal opportunity and discrimination issues and the Charter of Human Rights and Responsibilities.

The Legal Team within the branch provides legal advice to the Department in relation to employment law, administrative law and discrimination law matters and manages litigation at Fair Work Australia, state and federal anti discrimination Commissions and the Federal Court in relation to employment and discrimination.

The branch also has responsibility for the Department’s Criminal Record Checking policy and processes.
